The “C – 1” Retail Business District is intended for the purpose of grouping retail merchandising activities into a concentrated area serving the general shopping needs of the trade area. Principal permitted uses include department stores, apparel stores, general retail sales and services, and similar uses appropriate for comparison shopping.

The grouping is intended to strengthen the economic level of the central shopping district.

In the “C – 1” District, no building shall be used and no building or structure altered, enlarged, or erected which is arranged, intended, or designed for other than one of the uses listed in SECTION 3 below:

1.    Antique sales; providing all merchandise is displayed and sold inside a building.

2.    Apartments on floors other than the ground floor.

3.    Apparel and accessory stores.

4.    Appliance stores.

5.    Auditoriums, event centers, and similar places of public assembly.

6.    Automobile accessory and supply store.

7.    Bakery and pastry shops (retail only).

8.    Banks and other savings and lending institutions.

9.    Bars and taverns (licensed).

10.  Barber shops and beauty shops.

11.  Bicycle shops.

12.  Books and stationery stores.

13.  Churches.

14.  Dental clinics operated by persons holding a current and unrevoked license or certificate issued by the Kansas Dental Board.

15.  Drug stores and prescription shops.

16.  Dry cleaning establishments.

17.  Florist.

18.  Funeral Homes.

19.  Furniture and home furnishing stores.

20.  Government buildings.

21.  Grocery stores.

22.  Hardware stores.

23.  Heating and air-conditioning shops; provided all merchandise is located in a building.

24.  Hobby, stamp, and coin shops.

25.  Jewelry and metal craft stores and shops.

26.  Libraries and museums (public).

27.  Medical clinics operated by persons holding a current and unrevoked license or certificate issued by the Kansas Board of Healing Arts.

28.  Medical and orthopedic appliance stores.

29.  Office supply and office equipment sales and service stores.

30.  Offices (professional).

31.  Package liquor stores.

32.  Parking lots; customer and private.

33.  Parks and open spaces.

34.  Pet shops and services.

35.  Plumbing shops with five (5) or less employees, provided all merchandise is stored in a building.

36.  Recreational and fitness facilities.

37.  Restaurants.

38.  Service stations.

39.  Theaters (indoor).

40.  Travel bureaus.

41.  The following uses may be allowed by special use permit when submitted, reviewed, and approved by the Board of Zoning Appeals, and under such conditions as the Board may impose:

a.    Childcare facilities.

b.    Motor vehicle service and repair; provided that all work shall be performed and all materials shall be stored within an enclosed building; and provided further that all operable or inoperable motor vehicles determined by the Building Official to be a safety hazard or visual blight shall be screened from public view and access by a solid or semi-solid fence having a minimum height of six (6) feet and a visual density of no less than 90%.

c.    Private clubs, fraternities, sororities and lodges.

d.    Storage and warehousing except for products of a highly explosive, combustible or volatile nature.

e.    Wholesale establishments except those which handle products of a highly explosive, combustible or volatile nature.

No requirements except those to meet fire regulations.

No building shall exceed sixty (60) feet in height except as otherwise provided in the additional height, area, and use regulations of this Ordinance.

1.    Front Yard: No front yard is required for any building in the “C – 1” Retail Business District.

2.    Side Yard: No side yard is required for any building in the “C – 1” Retail Business District, except where a lot sides on any residential district, in which case there shall be a fifteen (15) foot side yard.

3.    Rear Yard: No rear yard is required for any building in the “C – 1” Retail Business District, except where a lot abuts on a residential district, in which case there shall be a fifteen (15) foot rear yard.
