The governing body of the city shall consist of the mayor and eight (8) councilmembers to be elected as set out in chapter 6 of this code.

All powers exercised by cities of the second class or which shall hereafter be conferred upon them shall be exercised by the governing body, subject to such limitations as prescribed by law. All executive and administrative authority granted or limited by law shall be vested in the mayor and council as governing body of the city.

(a)   The regular meeting of the Frontenac City Council shall be held on the first and third Monday of each month at the Town Hall Building located at 120 N. Labette St. at 6:30 p.m.

(b)   If a regular scheduled meeting of the Frontenac City Council shall fall on a City observed holiday, the meeting will be held on the following day at the same time and place.

At all meetings of the governing body, a majority of the councilmembers-elect shall constitute a quorum to do business.

The mayor shall preside at all meetings of the governing body. The mayor shall have the tie-breaking vote on all questions when the members present are equally divided. The mayor shall:

(a)   Sign the commissions and appointments of all officers elected or appointed;

(b)   Endorse the approval of the governing body on all official bonds;

(c)   From time to time communicate to the city council such information and recommend such measures as he or she may deem advisable;

(d)   Have the power to approve or veto any ordinance as the laws of the state shall prescribe;

(e)   Sign all orders and drafts drawn upon the city treasury for money.

At the first regularly scheduled City Council meeting in January following a general election, the City Council shall elect, from its membership, a president of the council. The president of the council shall preside at all meetings of the council in the absence of the mayor. In the absence of both the mayor and the president of the council, the council shall elect one of its members as “acting president of the council.” The president and acting president, when occupying the place of mayor, shall have the same privileges as other councilmembers.

(a)   If a vacancy occurs in any elective office by death, resignation, removal from the City, removal from office, refusal to qualify, or otherwise, the office shall be deemed vacant. Whenever a vacancy occurs in the position of City Council Member, the Governing Body shall, within 60 days of the vacancy, appoint an elector of the ward where the vacancy occurs for the balance of the unexpired term. If the Governing Body fails to fill a vacancy within sixty (60) days, the City shall hold a special election to fill the vacancy.

(b)   If a vacancy occurs in the office of the Mayor by death, resignation, removal from the City, removal from office, refusal to qualify, or otherwise, the president of the Council shall vacate his seat as a Council Member and become the Mayor for the balance of the unexpired term. Thereupon, the Council shall elect from its membership a new President of the Council. The vacancy created upon the Council President becoming the Mayor shall be filled pursuant to this Section

(a)   For the purpose of conducting the meetings of the governing body of the City of Frontenac, Kansas, at those times and dates that it is in session, the 2017 Edition of the “Code of Procedure for Kansas Cities” prepared and published by the League of Kansas Municipalities is incorporated herein by reference under the provisions of K.S.A. 12-3009 through 12-3012, and K.S.A. 12-3301 and 12-3302.

(b)   Said code is hereby supplemented and amended as follows:

(1)   Section 33. Same; Ordinary Ordinance; Council City. The adoption of an ordinary ordinance requires five affirmative votes of the council.

(2)   Section 35. Same; Ordinary Ordinance; Council City; Mayor's Veto. The mayor in council cities may veto any ordinance passed by the council on or before the next regularly scheduled meeting with the exception of ordinances on which the mayor casts the deciding vote or appropriation ordinances. Ordinances not signed or vetoed by the mayor take effect without the mayor 's signature. Any ordinance vetoed by the mayor may be passed over the veto by a vote of 6 councilmembers. The president of the council, acting in the absence of the mayor, shall have no power to sign or veto ordinances.

(3)   Section 37. Same; Charter Ordinance; Council City. The adoption of a charter ordinance requires six affirmative votes of the governing body. The mayor is considered a member of the governing body.
